Rachael Finch topless photos: Model in middle of legal battle over copyright issues

FORMER Miss Universe Australia Rachael Finch is in the midst of a bitter legal battle over topless photos she took over a decade ago.

Speaking to The Sunday Mail , Finch admitted the photos, taken by award-winning photographer Richard de Chazal, weren’t what she signed up for.

“I was under that impression I was there to do a beauty shoot and images of my head were going to be used on the website,” she told the publication.

“The brief changed when I arrived. I went along with it thinking this is my job description, but I didn’t feel 100 per cent comfortable.”

Disgraced Gold Coast cosmetic surgeon Ces Colagrande is being sued by the photographer who claims the surgeon used the photos for more than a decade without gaining any consent.

de Chazal claims he was “horrified” when the original topless photos of Finch went public.

In a separate incident, Colagrande was found guilty last week for sexually assaulting a patient back in 2015.

His website also still features the photos of Finch.

Colagrande is now serving a suspended nine month prison sentence and has been restricted from being alone with female patients.

A statement on Colagrande’s website now reads: “If you request to see Dr Colagrande alone, regardless of the matter, the clinic will be unable to take your appointment and direct you to another medical practitioner.”

While Finch did go along with the topless photos, she told The Sunday Mail she regrets it.

“I was young and naive at the time. I think it was one of my first ever photo shoots,” she said.

“I made a bad decision to go along with the revised brief and in hindsight I’m not proud of those images.”

Courier Mail approached Colagrande for comment who has filed a counterclaim against the photographer stating he cost him $100,000 for his delay at sending the photos.

de Chazal is suing him for $8, 550 for his service and is seeking damages for the copyright breach.

Finch, now 28, is expecting her second child with husband and former Dancing with the Stars partner Michael Miziner.
